Dive Centre Manager

Terms and Conditions

Last updated: 28 October 2026

These terms govern your use of Dive Centre Manager (the "Service"), a web application for running a dive centre, provided by Oceano Diligente, Unipessoal, Lda. ("we", "us"). By creating an account, starting a trial or using the Service you agree to them on behalf of your business.

1. The Service

Dive Centre Manager lets dive centres manage clients, certifications, bookings, boat lists, equipment, rentals, sales and related records. Features and plans are described on our website and may change over time. Features marked "coming soon" are not part of the Service until released.

2. Who may use it

The Service is intended for businesses and professionals. You confirm that you have authority to bind your business, and that your staff who use the Service will follow these terms. You are responsible for all activity under your accounts and for keeping usernames and passwords confidential.

3. Trials, plans and payment

4. Your data

You own the data you put into the Service ("Customer Data"), including your clients' records. You give us the right to host and process it only to provide the Service to you. For personal data in Customer Data, you are the controller and we are your processor; see our Privacy Policy. You are responsible for having a lawful basis to record your clients' data (including medical and certification details and data about minors), for obtaining any consents or parental approvals you need, and for the accuracy of what you enter.

Administrators can download all of their company's data at any time, on any plan, from Settings > My data (a ZIP file of spreadsheet-ready files plus stored documents such as signed forms). If you close your account, your data is deleted 30 days after your request. We remind the administrator by email about a week before, and you can cancel the closure until then. Backups that contain the deleted data expire within about 7 days. We keep invoices and billing records we must keep by law.

5. Acceptable use

You must not misuse the Service: no unlawful use, no attempts to access other companies' data, to disrupt or overload the Service, to reverse engineer it, or to resell it without our agreement. We may suspend accounts that put the Service or other customers at risk.

6. Safety and professional responsibility

The Service helps you keep records and spot issues (for example expiring certificates, medical declarations or age limits). It does not replace your professional judgement, your training agency's standards, or legal and insurance requirements. Warnings are aids only and may be incomplete or wrong. You remain solely responsible for diving safety, supervision, qualification checks and compliance. Certification agency names are trademarks of their owners; we are independent and not affiliated with them.

7. Invoicing and tax

Where the Service connects to invoicing or tax systems, you remain responsible for the correctness and legal validity of the documents you issue and the tax treatment you apply. Availability of automatic invoicing depends on country and system requirements.

8. Availability and support

We aim to keep the Service available and back up data regularly, but we do not guarantee uninterrupted or error-free operation. We may carry out maintenance, with notice where practical. Support for paid plans is provided by email and phone during our normal working hours. The Free plan comes with help articles and email replies as time allows, without a response time.

9. Intellectual property

We own the Service, its software, design and documentation. We grant you a non-exclusive, non-transferable right to use it during your subscription. Feedback you give us may be used to improve the Service without obligation to you.

10. Liability

Nothing in these terms limits liability that cannot be limited by law (including for intent or gross negligence, or for death or personal injury caused by negligence). Subject to that, we are not liable for indirect or consequential loss, lost profit or lost business, and our total liability for any claim relating to the Service is limited to the fees you paid us in the 12 months before the event giving rise to the claim. If you are a consumer, your statutory rights are not affected.

11. Term and termination

You may stop using the Service and cancel at any time. We may terminate or suspend your access for serious or repeated breach of these terms, after notice where reasonable. Closing your account deletes your data as described in section 4. Sections that by their nature should continue (data, liability, governing law) survive termination.

12. Changes to these terms

We may update these terms. For material changes we will give you reasonable notice by email or in the Service. If you keep using the Service after the change takes effect, you accept the updated terms; if you do not agree, you may cancel before then.

13. Governing law and disputes

These terms are governed by Portuguese law. Disputes will be handled by the competent courts in Portugal, without prejudice to any mandatory rights you have as a consumer. Consumers can also use the out-of-court options on our Dispute resolution page, and may make a complaint through the electronic Complaints Book.
